Worthless Check Unit

Susan Pate, Sheri Hill, Jesse Moses, and Kevin Thrasher handle all the daily functions of the Worthless Check Unit. Their duties include the intake of worthless check affidavits submitted for prosecution, receiving payments for worthless checks, issuing warrants for nonpayment of negotiable instruments, locating offenders and executing those warrants placing offenders in jail.  They also perform other duties as directed by the District Attorney.  

The Calhoun and Cleburne County District Attorney’s Worthless check unit is responsible for collecting restitution for victims of worthless checks.  The unit assists both businesses and individuals who have been presented with checks that have been returned either Insufficient Funds or Account Closed.  The service is no cost to the victims.  If the check is not paid through our office, we will assist in prosecution.

When a business or individual receives payment in the form of a check, the check must be deposited within 30 days of the date written to be eligible for collection through our office.  Once the item is returned NSF/Account Closed, notice must be made to the individual who SIGNED the check at the address on the check by certified mail.  Ten business days are allowed following the receipt of delivery before the check can be formally submitted to our office.

WHO IS ELIGIBLE TO USE THE SERVICE?
Any person who has received a worthless check while transacting business in Calhoun or Cleburne County is eligible.

WHAT IS THE COST OF THIS SERVICE?
There is no cost to the VICTIM

WHAT IF THE CHECK IS RETURNED REFER TO MAKER OR STOP PAYMENT?
If the check is returned REFER TO MAKER, you must contact the bank for additional information.  Many times a bank will issue the exact reason for return on bank letterhead that can be submitted with the check to our office for processing. 
If the check is returned STOP PAYMENT, civil action is required through Small Claims Division of the Courthouse.

WHAT IF I TAKE PARTIAL PAYMENT ON THE CHECK?
Partial payment prevents criminal prosecution.  Once the check is turned over to our office, the check MUST be paid through our office. 

HOW LONG WILL IT TAKE FOR ME TO RECEIVE RESTITUTION AFTER THE WORTHLESS CHECK WRITER PAYS?Once a check is paid through our office, you will receive a check from the District Attorney’s office by the 10th business day of the following month.
